Trademark ownership allows your brand to be the only brand with that business name, logo or slogan in your industry, In case you want to sue for trademark infringement, it’s presumed that you were the first to use the trademark, and the other party has deliberately copied it. Any slogan, business name, logo, short phrase, or other identifying items, may be trademarked. If a customer sees these marks and immediately thinks about your brand, then you have a protectable mark! All potential marks shall be used in commerce prior to obtaining registration with the USPTO.
Getting a Trademark with USPTO takes about 12 – 18 months. However, it might take longer if issues arise with your application. The good news is you can put a ™ symbol next to your mark once you have filed the application. This ™ symbol notifies others that you are in the process of obtaining a registration for this mark. Once the mark is registered, you may then use the ® symbol next to your mark, which indicates that the mark is registered with the USPTO.
